They can't legalize it because it is federally illegal which trumps state law. They are only trying to tax the sale of an illegal substance. If you would have read the entire article you would see that it is pretty much impossible to do so. Basically nothing is going to happen...unfortunately.

Lol at the Government trying to tax illegal stuff.. do you really think a drug dealer will log off on his income taxes "Marijuana sales: $60,452"?

But they can "legalize for medical use", but that's about it.

Even if they "legalize" it for medical use the federal government could come in at any time and bust those in possession of it, even if they were "safe" under state law.

That's true, but isn't it legal in other places already for medical use?

Yeah, it wont get legalized on a state level, since it is impossible because it is federally illegal. Even medical marijuana, the states says you can have it, but the country does not. So you can STILL get arrested and charged for it on the federal level. EVEN if it is prescribed. When they first made pot illegal, it wasn't illegal if you had a special "ration" stamp that was produced by the government, but they never made any. But then there was a court case and it turned straight illegal instead of illegal without a stamp.

I just watched this on the news last night. The state police won't do anything about it if you have the card that says a doctor recommended it to you. Federal law enforcement such as the DEA and FBI will bust you.

Even medical wise, it's technically illegal on the federal level.

The FBI and DEA won't waste their time on petty abuse.

I'd like to see how Cali is going to make this legal when its not in their hands until the federal gives the rights of marijuana to the states.

Some guy on the news had a store that sold cannabis 'medically'. He was paying over $250k a year in just sales taxes. Is that 'petty abuse'? Although now that he was on the news he will probably be arrested and beat to death as a terrorist...

Yeah, medical will only get so far. As for the vote, I think that it is a way for that state to make a statement to the rest of the United States. If this vote passes... take into account the number people in California. That will be making a great point to the rest of the world... and they may be hoping that it will create a larger scale vote... we never know...

Incidentally, this topic has been coming up in the news recently because the Obama administration has announced that it won't be pushing federal enforcement of drug law violations, instead leaving that to the state governments. So states like California where drugs like MJ are legal under some circumstances won't have problems with federal raids on state-authorized enterprises.

This is a state's-rights issue with a very long history. In this case the federal government is finally stopping an activity that many of us believe it never had the right to do in the first place.
