    This. If there is a chance it is not winable, then there is always the possibility of a counter-sue, which would put you in an even deeper hole..

    Hey hey, my dad's a lawyer.

    Going to court over this would only be worth it IF the other kid has got less suspension than you got.

    If you got punished more than him while your actions were in defense of your sister, you can go to court and win. There is favoritism involved, etc.

    If he got punished as much or more than you, then your punition is considered fair, because no form of violence is acceptable according to school standards (IRL it's another can of tuna).

    And I don't want to be talking out of my ass, but for such a trivial lawsuit you wouldn't be needing a lawyer in Canada, I don't know about USA.

    EDIT : This did not happen on school territory, I find it very unlikely that you should get suspended?

    The boy didn't get punished at all.

    The boy's uncle was the school board leader...

    Well, my first real day of suspention. Got loads of calls from people, and did alot of work... Yes, they give work to do when you're suspended.

    @Tarajunky : That would be an aggression towards the school itself, which would worsen my situation even more and even after my suspension is over.

    Althought it would be a nice thing to do.

    You could probably win the case (but to be sure speak to a lawyer), for witnesses you know that there were other kids there so you could use them, if there is a kid that would for sure tattle on the guy who beat up your sister and he/she is a witness, go!

    You got suspended and that asshole didn't? You could use that in the court, just because the kid is their family doesn't mean they can protect him like that in school.

    Man, these fucking pokemon are killing kids these days...

    This kind of crap just makes my blood boil. Anyone would react violently to seeing their little sister getting beat up, especially by an older boy, with others with him. Just cowardly and pathetic in so many ways.. IMHO if you're prepared to start a fight or hit someone you should be prepared to get hit too as a consequence instead of crying to your parents and uncle about it.

    But yeah, when it comes to the hitting part in Finland you'd most likely be the guilty one, or atleast you'd face the worse punishment (the kid would most likely just get some fines and whatnot because he's younger and blah blah), and can't really say anything about the school part as I don't know how the school system works around there.. Gl, anyhow, but I wouldn't suggest taking this to the court.

    Give your sister a course self defense for her next birthday.

    Other than that, I really think you should take this to 'the next level'. A school has to make the right example, which here clearly isn't the case. Keep us informed on any further actions .

    It's always so that when shit happens to you, the law will make sure there's more coming, for example, my friend got beaten up including them hitting his head on the ground by two guys while my other friend fought back a bit, and it just went to uhm... Sovittelu ("agreement")... But for sure if my other friend had knocked the two out cold or something he'd gotten a real punishment...

    Wooooo ! Great news !

    I'll make it short, well, as short as I can :

    The school called me in the afternoon, while I was doing my daily 25 exercises and told me to meet them in the school at once.

    I was there, everybody looked at me, wondering why I was here, the teachers didn't want me to talk with them.

    I came into the room, my parents, the school board, the boy, and 2 other people were there.

    The boy was crying.

    They asked me to tell the story again, which I did.

    The 2 unknown ones "nodded" (correct ? :S) and the school board leader began by saying : I'm extremely sorry for what has happened". I asked why.

    They told me that one of the boys of that little group had apparently admitted everything to his parents, the two unknown ones.

    The parents had then called the school to clear up things and the school then arranged this little meeting.

    Tonight, me, my sister, and my parents are having a little special dinner .

    I'm so happy, thanks for all the support, I'm so relieved that this is over.

    In my eyes, the only ones in this story who got to get a real thank you are :

    -The boy who admitted
    -The boy's parents
    -My family, who backed me up, supported me and trusted me all the way through
    -Finally, you SRL, who gave me some hope as well as tips on how to sort this out.

    If you are part of the minority, you could take it to court as discrimination, if you are part of the major populous, and the school board leader happens to be another race/nationality/etc. you could take it to court saying he was lashing out because he doesn't like your race.

    Wow.. I was away for a bit.. and I just read up on the whole thing... That is seriously messed up... I am an extreme passive > aggressive person. When it comes to me personally, I am beyond a passive individual, however, when it comes to others I will be aggressive on all fronts, especially concerning the well being of family members....
    With the board... if you were ever to take it to court, you would have a case... "suing for millions" is would just be ridiculous tho.
    CONGRATS on the getting everything straightened out. What is the school going to do on their end to correct the wrongdoing that has gone on? I am happy that your suspension has been lifted. I hope your family meal is enjoyable. Have a nice day.
