    Ahhh that makes sense now.

    But still that makes sense... you can't be tried for the same crime more than once. Seems like its pretty self explanatory and cut and dry to me...

    Don't get me wrong I think in that case it is REALLY messed up. But if someone was tried for a crime they didn't commit and proven not guilty then they couldn't be tried again and again and again until it turns out that particular time they are found guilty.

    While they cannot be tried for that crime of killing the person again, chances are they will be investigated and someone will find an excuse to try him again. Companies that sue people take them to court over and over again till they win... and I think double jeopardy applies their too. Always an excuse lol

    Im assuming he can be charged for 1st degree murder, then if found not guilty be charged for 2nd or 3rd?

    Joke, he cannot be charged for the same crime. The courts need to find another crime(and with laws nowadays its not hard >.>) and try him for that. They then bring up some evidence against him from the last case, and the jury hates him and votes guilty. He will be sentenced based on the new crime, and not the previous murder though

    New charges are Man slaughter in the first degree, assault with deadly weapon, criminal conspiracy etc etc. consecutive sentences, say goodbye to 50 years.
